Terms of Service

These Terms of Service (the "Terms") govern your use of CallRoute, including the website at usecallroute.com, the CallRoute apps and the related voice, messaging and AI services (together, the "Service"). The Service is provided by ZenTalk LLC ("CallRoute", "we", "us"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and the business you represent ("you").
1. Your account
You must be at least 18 years old and able to enter a binding contract. You are responsible for the accuracy of the information you give us, for keeping your login details secure, and for everything that happens under your account, including the activity of users you invite to your workspace.
2. Plans, wallet and payment
Paid plans are billed per user in advance for the billing period you choose and renew automatically until cancelled. Usage outside your plan, such as extra numbers, international calls, calling beyond fair use and extra AI receptionist minutes, is charged from your prepaid workspace wallet at the rates shown in the app and on our pricing page. Wallet balances are not cash, do not earn interest and are not transferable. Prices exclude taxes unless stated. Payments are processed by Stripe.
We may change prices with at least 30 days notice. Changes apply from your next renewal. Refunds are covered by our Refund Policy.
3. Fair use
Plans that include unlimited US/CA calling or texting are for normal business communication by the user the seat is assigned to. Fair use limits are listed on the pricing page. Auto-dialing, call centers reselling minutes, traffic pumping, and sharing one seat across several people are not normal use. Usage above the fair use limit is charged from your wallet.
4. Acceptable use
You agree not to use the Service to:
- send unsolicited messages or calls, or contact people who have not given the consent required by law;
- violate the Telephone Consumer Protection Act, CAN-SPAM, carrier messaging rules or any other law;
- spoof caller ID, impersonate others or mislead the people you contact;
- send content that is illegal, harassing, hateful or deceptive, or that promotes prohibited goods;
- interfere with the Service, probe it for vulnerabilities or access it without permission.
Carriers may block or filter traffic that breaks their rules. We may suspend numbers or accounts that put the Service, our carriers or other customers at risk.
5. Business texting registration
US carriers require businesses to register before sending texts from local numbers (A2P 10DLC) and to verify toll-free numbers. You agree to provide accurate information for registration and you authorize us to submit it to our carrier partners on your behalf. Registration fees charged by carriers and registries are passed through to you. Approval decisions are made by third parties and are not guaranteed.
6. Phone numbers
Numbers are provided by our carrier partners and are not owned by you or us. While your account is in good standing you may port your numbers to another provider. If your account is closed or unpaid, numbers may be released after a reasonable grace period.
7. Emergency calling
The Service is not a replacement for a traditional phone line for emergency calls. Emergency calling may not work during power or internet outages, and the location sent to emergency services is the address you register, not your physical location. You must keep your registered emergency address up to date and tell your users about these limitations.
8. Recording and AI features
Call recording, transcription and AI features are off unless you turn them on. Recording and transcription laws differ by state and country and some require the consent of every party. You are responsible for giving any notice and getting any consent required. AI output can be inaccurate, so review it before relying on it.
9. Your content
You keep all rights to the calls, messages, recordings, contacts and other content you put into the Service ("Customer Content"). You give us permission to host, process and transmit Customer Content only to provide and improve the Service for you, as described in our Privacy Policy. We do not use Customer Content to train AI models for other customers.
10. Availability and changes
We work hard to keep the Service available but do not guarantee it will be uninterrupted or error free. During early access, features may change, and some features shown on our website roll out over time. We may update the Service and these Terms. If we make a material change to the Terms we will notify you by email or in the app before it takes effect.
11. Cancellation and termination
You can cancel at any time from Settings. Cancellation takes effect at the end of the current billing period. We may suspend or terminate your account if you materially breach these Terms or do not pay. After closure you can export your data for 30 days, after which we may delete it.
12. Disclaimers and limitation of liability
The Service is provided "as is" to the extent allowed by law. To the extent allowed by law, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits or revenue, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
13. Indemnity
You will defend and indemnify us against claims arising from your Customer Content, your messaging and calling practices, or your breach of these Terms or the law.
14. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law rules. The state and federal courts in Harris County, Texas have exclusive jurisdiction over any dispute.
